The situation of persons in places of detention controlled by the militants territories of Donetsk and Lugansk regions, accompanied by a number of problems, including inadequate medical care, cases of torture and ill-treatment and detention without adequate grounds.

According to the results of a study conducted jointly with “Donbass SOS”, Luhansk regional human rights center “Alternative” and the Public Committee for the protection of constitutional rights and freedoms of citizens, now in the penal establishments on the territory ORDO only have basic medicines and proper treatment not given to those patients, relatives whom are not able to pass the required medicine.
In individual institutions of Donetsk and Lugansk regions is the use of forced or unpaid labor.

Human rights activists also claimed a lack of heating, damaged from the shelling of the building; the lack of quality drinking water and the hourly supply regarding institutions; cases of torture and ill-treatment from which most suffer those who do not accept change of power.
In addition, the number of issues – detention without cause, as part of convicted prisoners in places of detention in ORDA already have grounds for dismissal in accordance with Ukrainian legislation.
Human rights activists said the convicts have on-site ORDO is no guarantee of safety in case of escalation of the conflict, and in some of them severe psychological condition due to the lack of actual ability transfer to the territory controlled by Ukraine.
In this regard, underscores the still unresolved problematic issues regarding the lack of an effective mechanism of transfer of sentenced persons from ORDO for further punishment on the government-controlled Ukrainian territory, the settlement of the legal status of persons serving sentences in the temporarily occupied territories, etc.

Human rights activists recalled that in the summer of 2014, the representatives of illegal armed groups have taken control of establishments of execution of punishments on the territories that are actually controlled by the Ukrainian authorities. At that time, according to the State penal service of Ukraine, was such 14 prisons in Luhansk region and 14 in Donetsk. As of November 2014, there were 16.2 thousand people (9.7 thousand people in the Donetsk region and 6,5 thousand – in Lugansk).
Today from the temporarily occupied territory to serve their sentences controlled by Ukrainian government territories were transferred to 186 people, which is slightly more than 1% of the total number of persons remaining in prison in ORDA. In this case we are talking only about the persons from the Donetsk region for more than four years, no one convicted of Luhansk region were not transferred.
According to the survey, almost 90% of prisoners (and their families) who answered the question, want to serve their sentence at the government-controlled Ukrainian territory.
