Both draft laws on cancellation of immunity gone to the constitutional court
Uncategorized October 19, 2017Verkhovna Rada sent to the constitutional court both of the bill on the abolition of parliamentary immunity: one who has submitted to the Parliament by the President Petro Poroshenko, and alternative – from a group of deputies. To include in the agenda and send to the COP the draft amendments to article 80 of the Constitution concerning parliamentary immunity, No.7203, voted by 336 deputies. The document provides for the repeal of provisions under which a Deputy may not be prosecuted, detained or arrested without the consent of Parliament. Modifications are proposed to enter into force from January 1, 2020, that is for the Parliament of the ninth convocation.
Also Parliament included in the agenda and sent to the COP for presentation of the report of the Deputy project No.6773. It was voted 328 deputies.

If the constitutional court will give a positive opinion on the presidential draft law, the deputies will consider it in the first reading. For decision making they will need a minimum of 226 votes. In General, the MPs will vote for the change only at the next session, that is fall 2018. This was stated by President’s representative in Parliament Iryna Lutsenko, answering questions of deputies. For decision making on changes to the Constitution as a whole will need to collect at least 300 votes.
“It will take some time, we get the conclusion of (CS, – ed.). According to the Constitution must be separated by the adoption of the draft on first reading at one session, and the vote in the second reading should be on another session. In this process we will enter in the fall of 2018,” she explained.
