The theme of the day. Why is the detectives NAB rummaging in the trash of the Ministry of justice

The Prosecutor General’s office received another complaint on NABOO. The leadership of the Ministry of justice is outraged by the fact that the detectives Bureau allegedly illegally searched the Ministry documents that the justice Ministry had to provide the NEB according to the court. WHERE TO START. 1 June 2017 NABOO opened criminal proceedings on the fact of possible abuses by officials of the Ministry of justice of his official position (part 2 of article 364 of the criminal code), which resulted in the possible embezzlement of more than 54 million UAH with the direct participation of employees of the Ministry.

Case it concerns the long-standing dispute between the companies Golden Mandarin and Kyivenergo. According to first Deputy Minister of justice Natalia Bernatsky, in the 2000 years of the Golden Mandarin gave Kyivenergo for the storage of fuel oil, which subsequently she refused to return. The company complained to the European court of human rights, which adopted a decision on compensation. Ukraine has paid Golden Mandarin this compensation from the state budget. In 2017, the justice Ministry filed a lawsuit to Kyivenergo for the return of these funds.

Suddenly this morning, Bernatsky wrote in his Facebook about “masks-show NABOO in the Ministry of justice”. Detectives allegedly without sanction of court “stormed” the building of the Ministry, robbed the cleaners keys to the offices and shut the door, and when the officials came in, the detectives NAB allegedly fled through the back door. It is worth noting that the Minister of justice is the quota of the popular front, the head of the faction which is one of the authors of the draft law on parliamentary control over NABOO.

The Bernatsky quickly organized the briefing, which reported that the Ministry of justice appealed to the Prosecutor General with the statement “offence”, allegedly committed by employees of the NABU. In addition the official said that similar complaints on NABOO prepared to address the ambassadors of the G7 countries and the U.S. justice Department.

However, the Deputy head of the Ministry of justice noted that the search, this time sanctioned, was also at home and in the car of the head of the Secretariat of the Department.

HOW IT DEVELOPED. NABU presented an entirely different picture of what happened. According to the head of the division of detectives to NAB Alexander Kareev, December 6, the Bureau has provided the Ministry of justice, the court’s decision on the necessity of issuing documents that are material evidence in the case of possible embezzlement of UAH 54 mln. Access to these materials detectives sanctioned 23 November in the Solomensky district court of Kiev.

Yesterday, 7 December, the NEB received operational information that some of these documents have already been destroyed and is in the basket at room # 413 one of the employees of the Ministry, and the other part taken from the Ministry of justice with the purpose of concealment. In this regard, the detectives made the decision on carrying out of urgent search. As explained by the correspondent LIGA.net in NABOO, the detectives had every right to hold it according to part 3, article 233 CPC. Now the NAB asked the court to obtain a warrant to seize the evidence found.

According to Kareev, this morning, before “the trash will take cleaner,” detectives NABOO came to search room 413 of the justice Ministry. He noted that “there was no mask-show”, the search was conducted in the presence of witnesses and guardian of the Ministry. He also continuously recorded on video. In the trash, according to the representative of NABOO, detectives found the desired “fragments of documents”. And during a search in apartment of the head of the Secretariat of the Ministry of justice had seized the originals of the other documents.

NABU wonder why some of the documents that were requested of the Bureau by the DOJ, was in the wastebasket in tattered form, and the other part of the house employee of the Ministry.

Karev also reported that according to the NAB, the head of the Secretariat, arrived yesterday at the Ministry of justice and the Cabinet №413 “took part in the destruction of documents.”

WHAT WILL HAPPEN NEXT. With high probability, then the GPU will open the regular criminal proceedings against conducting a search of the detectives NAB, and critics of the Bureau will get another occasion to loud statements about the use of unlawful investigative activities and the need for an urgent audit, and, preferably, with the participation of the ‘right’ auditors. Apparently by coincidence, today NACP closed access to the staff offices to the registry e-filing. Yesterday’s attempt to push through Parliament a bill about the control of NABOO and the dismissal of the head of the anti-corruption Committee Yegor Sobolev – also, apparently, a coincidence that does not indicate a massive attack on the Bureau.
