KIEV. The 4th of July. UNN. The economic court of the Nikolaev area, yesterday declared bankrupt public joint stock company “black sea shipbuilding plant”. About it reports a press-the centre of judicial power of Ukraine, reports UNN.
“The former leader of the Ukrainian shipbuilding for a long time experienced difficult times. For the purpose of financial improvement of the enterprise in 2015 was introduced in the process of rehabilitation of the plant, than the economic court made the appropriate ruling. However, unfortunately, the system of measures on restoration of solvency of the debtor could not prevent the bankruptcy of the debtor”, – stated in the message.
So, guided by articles 28, 37, 38, 40, 114 of the law of Ukraine “On restoring debtor’s solvency or declaring bankruptcy”, Economic court of the Nikolaev area 3 July 2018 decided to stop the procedure of reorganization of open joint stock company “black sea shipbuilding plant”, to recognize the Public joint-stock company “black sea shipbuilding plant” bankrupt and start liquidation procedure.
According to the decree, the period of performance for all monetary obligations of the bankrupt is considered to have occurred. The accrual of penalties (fines, penalties), interest and other economic sanctions on all types of debts of the bankrupt. From that bankrupt there are no additional obligations (in particular for payment of taxes and duties (mandatory payments), except for costs associated with the implementation of the liquidation procedure. Sale of the bankruptcy estate is allowed in the manner prescribed by article 44 of the law of Ukraine “On restoring debtor’s solvency or declaring bankruptcy”.
Canceled arrests imposed on property of the debtor recognized by the bankrupt, and other restrictions on the disposal of property of the debtor. Imposing of new arrests or other restrictions on the disposition of property of a bankrupt is not allowed.
The liabilities of a debtor recognized by the bankrupt, in cases and manner prescribed by section III of the law of Ukraine “On restoring debtor’s solvency or declaring bankruptcy”.
From the date of adoption by the economic court about recognition of the debtor bankrupt and opening of liquidation procedure for termination of the powers of the management bodies of the bankrupt for the management of bankruptcy and the disposal of his property, the Manager of the bankruptcy is dismissed from work in connection with the bankruptcy of the enterprise, and also terminated the powers of the owner (owners) of the property of the bankrupt .
Recall, 13 July 2017, the Pechersk district court of Kyiv seized the 99,87% of shares and immovable property of JSC “black sea shipbuilding plant”.
