SAP is appealing the sentence to employees of SBU in Odessa region

KIEV. 22 Dec. UNN. Prosecutors of the Specialized anti-corruption prosecutors are preparing an appeal against the decision of the Kyiv district court. Odessa, December 15, 2017, which evaluated the prosecution evidence of employees of management of security Service of Ukraine in Odessa region as an attack on the misappropriation of another’s property by deception, however, however, everything indicates receipt of unlawful benefit to the accused found guilty of the employees in the Commission of a crime. This is stated in the message SAP on the page in Facebook, reports UNN.

“December 15, 2017, the Kiev district court of Odessa on the results of the trial found guilty staff of Management of security Service of Ukraine in Odessa region with a crime under part 2 of article 15, part 4 St. 190 criminal code of Ukraine, that is, the attempted misappropriation of another’s property by deception (fraud) committed on preliminary arrangement by group of persons in especially large size”, – stated in the message.

According to prosecutors SAP, the trial court evaluated the prosecution evidence as the attempted misappropriation of another’s property by deception, but according to investigators, it all points to taking undue advantage of the accused.

Pre-trial investigation in this production began, the military Prosecutor, and later was carried out by the NEB under the procedural management of SAP.

“The court, in assessing the court received evidence, heard witnesses, examined the materials of criminal proceedings, assessed all the circumstances together, found them guilty of a crime and sentenced to 5 years imprisonment with confiscation of all property belonging on the right of private ownership in the state.

The measure of restraint in form of detention unchanged with a decrease in the amount of collateral up to 80 (eighty) living wage for able-bodied persons, established on January 1, 2017, which amounts to 128 000 UAH “, – added in SAP.

As noted in the Department, preliminary investigation bodies and the Prosecutor in the proceedings brought and maintained in full public charge under part 4 of article 368 UK of Ukraine (namely the receipt by the official of illegal benefit in especially large size) as follows.

“The defendants, being officers holding a responsible position, acting intentionally, by previous concert by a group of persons from mercenary motives, for personal enrichment during the time period from 20.11.2015 at 13.12.2015 demanded illegal benefit in the amount of 70 000 USD, that is especially large size, for failing to initiate criminal prosecution of the Bishop – vicar of the Odessa diocese of the Ukrainian Orthodox Church and the destruction of incriminating him, and 13.12.2015 about 15:30 hours to complete the approved plan of the Commission of a criminal offence in the premises of office of the last received part of the agreed upon illegal benefit in especially large size in the amount of 50 000 USD, at official rate of the National Bank of Ukraine amounted to 1168 of 145.95 hryvnia,” – noted in the pad.

SAP prosecutors are preparing an appeal against the mentioned verdict of the court to properly assess the evidence, the version of the investigation clearly indicate receipt of unlawful benefit to the accused.

As reported UNN, this year , the SBU has prosecuted 16 of its employees.
